Learning outcomes

At the end of this learning unit, the student is able to :

The course aims to enable students to familiarise themselves with comparative methods that allow to identify the main features of the principal legal systems (Anglo-Saxon law, continental law, Islamic law...). Around thirty judgments pronounced by foreign courts (France, Great Britain, Germany) relating to liability for omissions issues, privacy law, etc. are analysed during the course. Students are required to participate by analysing the judgments prior to their examination in class. This knowledge can be very useful for students who wish to continue their academic training in English, as they will be more regularly faced with participatory methods.

Content

a) Importance and usefulness of comparative law in the legal analysis;
b) Analysis of the different comparative methods;
c) Romano-Germanic law, Common Law and Islamic Law
d) Application of comparative methods to extra-contractual liability law.

Teaching methods

The syllabus will be accompanied by various cases. The student is expected to prepare each course by answering questions on cases decided by Anglo-Saxon, German, Belgian, French and American courts.

Evaluation methods

A 2 hour written exam, focusing mainly on case law. The student must put himself in the shoes of one of the parties by developing a relevant legal reasoning while reasoning by analogy with the judgments examined in the course. Great importance is attached the legal terminology.

A syllabus in English of 200 pages will be given to students.
