Learning outcomes

At the end of this learning unit, the student is able to :

Understand the impact of the development of the Internet on our society, which has become the "information society", and particularly on fundamental rights and freedoms. Technological development is presenting new challenges for rights and freedoms: the right to privacy is being called into question by the commoditisation of personal data and the monitoring of every trace we leave when we use technology; freedom of information is being undermined by the spread of disinformation and fake news; freedom of movement is being called into question; political rights are being undermined; the electoral process is being affected, and so on.

  1. Introduction: what is the 'information society'?
  2. The Internet and new challenges for rights and freedoms: challenges to the right to privacy, freedom of information and communication, freedom of movement, political rights (the right to vote), etc.
  3. The evolution of the concept of privacy in the doctrine and case law of the European Court of Human Rights
  4. The protection of personal data: international recognition; GDPR (European General Data Protection Regulation)
  5. Data transfers
  6. Internet and privacy: surfing traces, spam, cookies
  7. Protecting freedom of expression and information on the Internet
Teaching methods
The course methodology mixes lectures and case studies.
Evaluation methods
Assessment is by means of an oral examination. This examination can be replaced by a written assignment on a topic chosen among the designated list which is made available to students or on a topic proposed by the student.
Other information
The students have at their disposal a collection of texts and documents; the slide presentation is made available to students via the course website.
