2023.

As of 1st of June 2023, after years of negotiations, setbacks and postponements, the Unitary Patent Package (UPP) enters into force: the European patent with unitary effect (EPUE) becomes a reality and the Unified Patent Court (UPC) starts its activities. With twenty-eight contributions from academics and practitioners, this OA book proposes first to put the new system into historical, comparative and institutional contexts, second to highlight the issues it raises from an  EU law, third to address the institutional, jurisdictional and procedural questions raised by the UPC, fourth to investigate some innovation and markets issues, and lastly to discuss possible improvements and alternatives. 

Despite the economic relevance of trade secrets, their legal protection is not based on a robust theoretical corpus, and a large uncertainty remains regarding how they should be legally apprehended. The present book investigates the foundations of their legal protection by assessing its justifications and aims to define how this legal apprehension should be organized. 

2022.

New digital technologies have become essential tools to facilitate and improve the management of copyright-related data. Some technologies can substantially improve the management of rights linked to protected content and thereby enhance better remuneration for creators and development of new content services. Moreover, technologies such as AI have a great potential to contribute to the production and distribution of copyright-protected content (e.g. books, films, sound recordings or videogames). This study analyses two issues linked to copyright and technology. The first part looks into the potential use of new technologies to improve the management of data linked to copyright-protected content by European creative industries. The second part concentrates on the copyright-related challenges raised by the use of Artificial Intelligence (AI).

This book looks at the origins of copyright, its evolution in the face of new technologies and practices, and its future, which needs to be re-imagined in Europe.
