Content
The course addresses key topics of European Union (EU) law from the EU’s origins and nature to contemporary legal issues in a constitutional sense focusing on processes and questions central to today’s EU. It does so through an analysis of the case-law of the Court of Justice of the European Union (CJEU) as well as different doctrinal perspectives on EU law. In particular, the course focuses on the notion of “constitutionalisation” of the EU legal order, EU competences, sources of EU law, the EU institutional framework and democracy. It also looks at the EU protection of fundamental rights, Union citizenship, the rule of law, and effective judicial protection. The course is case-law focused and debate-driven and prepares students to analyse leading CJEU judgments and reflect on current controversies of EU law.
Evaluation methods
The evaluation for this learning unit includes both the permanent evaluation of in-class graded exercises (30%) and a final paper (70%). The grades for the exercises will carry over to the August session.
Online resources
The reading materials necessary for the preparation of class (case law and scholarly work) will be available on Moodle as the class progresses. PowerPoint presentations will also be available on Moodle.
Each lecture is accompanied by a set of assigned readings (CJEU case law and doctrinal articles engaging with topics relevant to the constitutional law of the EU). Students are expected to attend classes and participate actively.
